Terms of Service

Access to and use of the iMirus' web site and other iMirus Internet services are subject to the following Terms of Service. Please read these Terms of Service ("Terms") carefully. Creating an account with iMirus or otherwise using or accessing the iMirus Service will signify Your acceptance of these Terms and constitute a binding agreement between You the account holder ("You," "Your," "Yourself," "User") and iMirus ("Agreement"). If You do not agree to these Terms, discontinue use of the iMirus Service immediately. iMirus's acceptance is expressly conditioned on Your assent to these terms.

 

1 Product or Service

 

The iMirus Product or Service is operated by Riggs Heinrich Media, Inc. ("iMirus" and "Product(s) or Service(s)"). The iMirus Product or Service includes the iMirus store web site or any iMirus related web sites that provides You the capability to purchase and subscribe to various magazines, catalogs, books, and other publications and products – in print and/or digital form – and where applicable, will have certain digital products delivered to You via e-mail by other digital means. Use of the iMirus Reader software (both online and in download form collectively ("iMirus Reader(s)") are further subject to the iMirus Reader License Agreement.

 

2 Consumer Account

 

Certain portions of the iMirus Service are available only to individuals who have registered with and obtained a password from iMirus. By registering with iMirus, You certify that You are at least 18 years of age. You may not provide or use a password, email address, or any other information of anyone else without the owner's authorization. You agree to provide true, accurate, current and complete information about Yourself when You register with or order a product or Service from IMirus, and to maintain and promptly update that information to keep it true, accurate, current and complete. You are responsible for maintaining the confidentiality of Your account and password and for restricting access to Your computer or other computing devices that may access or host and iMirus Product or Service, and You agree to accept responsibility for all activities that occur under Your account, including the selection and use of all content, Products and Services.

 

3 User Conduct

 

You may only use the iMirus Product or Service for lawful purposes and in accordance with these Terms, any operating rules established by iMirus and the iMirus Reader License Agreement. iMirus reserves the right to refuse service, terminate accounts, or cancel orders in its sole discretion, including, without limitation, based on any activity by a User in violation of these Terms.

 

4 International Users

 

The iMirus Products and Services are controlled, operated and administered by iMirus from its offices within the United States of America. If You access the iMirus Products and Services from a location outside the United States, You are responsible for compliance with all local and international e-commerce laws. You agree that You will not use the iMirus Products and Services accessed through the iMirus Readers in any country or in any manner prohibited by the United States Export Administration Act or any other applicable laws, restrictions or regulations.

 

5 Intellectual Property

 

All content included as part of the iMirus Service, such as text, graphics, logos, button icons, images, as well as the compilation thereof, and all software used on this site, is the property of iMirus or its suppliers and protected by United States and international copyright laws. You agree to abide by all copyright notices, legends or other restrictions contained in any such content and will not make any changes thereto.

 

Each third-party content provider owns the copyright on content original to it including, without limitation, on the magazines, catalogs, books, and other print or digital content delivered or otherwise made available to You by the iMirus Products and Services (the "3rd Party Content"). Except as permitted by the 3rd Party Content 's lawful owner, You acknowledge that You do not acquire any ownership rights by downloading copyrighted material.

 

Except as explicitly permitted under copyright law and by the features of the iMirus Products and Services and iMirus Readers software, You may not modify, reverse engineer, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way commercially exploit or provide to a third party the content of the iMirus Web site, the 3rd Party Content, or any portion of them without the express permission of iMirus and the copyright owner.

 

IMirus' does not grant You any licenses, express or implied, to the intellectual property of iMirus or our licensors except as expressly authorized by these Terms or the iMirus Reader License Agreement.

 

6 Third-Party Content

 

iMirus is a distributor of 3rd Party Content. Accordingly, iMirus has no editorial control over such content. Any opinions, advice, statements, services, offers or other information or content expressed or made available by third parties, including those made in 3rd Party Content offered by the iMirus Service, are those of the respective author(s) or publisher(s) and not of iMirus. iMirus does not guarantee the accuracy, completeness or usefulness of any content, nor will we be liable for any loss or damage caused by Your reliance on information obtained through the iMirus Products and Services.

 

The iMirus Product and Service may contain links to other Internet sites and third-party resources. iMirus does not assume any responsibility or liability for communications or materials available at such linked sites. These links are provided for Your convenience only. You are solely responsible for understanding any terms and conditions that may apply when You visit or place an order with a third-party site.

 

7 Modifications to Products and Services

 

iMirus reserves the right at any time to modify or discontinue, temporarily or permanently, the iMirus Products and Services (or any part thereof) with or without notice. You agree that iMirus shall not be liable to You or to any third party for any modification, suspension or discontinuance of the Service.

 

8 Disclaimer of Warranties

 

THE IMIRUS SERVICE AND ALL CONTENT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. IMIRUS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.WITHOUT LIMITING THE FOREGOING, NEITHER IMIRUS NOR ITS AFFILIATES, LICENSORS OR AGENTS, MAKES ANY WARRANTY THAT (A) THE IMIRUS PRODUCT AND SERVICE WILL MEET YOUR REQUIREMENTS, (B) THE IMIRUS PRODUCT AND SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE IMIRUS PRODUCT AND SERVICE WILL BE ACCURATE OR RELIABLE, OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE IMIRUS SERVICE WILL MEET YOUR EXPECTATIONS.

 

YOU BEAR THE RESPONSIBILITY FOR OBTAINING AND MAINTAINING RELIABLE INTERNET CONNECTIVITY. IMIRUS IS NOT RESPONSIBLE FOR YOUR INABILITY TO DOWNLOAD CONTENT.

 

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE IMIRUS PRODUCT AND SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

 

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM IMIRUS OR THROUGH OR FROM THE IMIRUS PRODCUT AND SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

 

9 Limitation of Liability

 

IN NO EVENT WILL IMIRUS OR ITS AFFILILATES, LICENSORS, OR AGENTS BE LIABLE UNDER ANY THEORY OF LAW, FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

 

10 Indemnification

 

You agree to defend, indemnify and hold harmless IMirus, its licensors, suppliers and any 3RD Party Content providers to the Product and Service and their respective directors, officers, employees and agents from and against all claims, losses, expenses, damages and costs, including reasonable attorney's fees, arising out of Your use of the iMirus Service and resulting from any violation of these Terms or any activity related to Your account (including negligent or wrongful conduct) by You or any other person accessing the Product and Service using Your account.

 

11 Monitoring

 

iMirus has the right, but not the obligation, to monitor the iMirus Product and Service to determine compliance with these Terms and any operating rules established by iMirus; and to satisfy any law, regulation or authorized government request. Without limiting the foregoing, we shall have the right to remove any content that we, in our sole discretion, find to be in violation of the provisions hereof or otherwise objectionable or in breach of iMirus's licensors' obligations.

 

12 Termination

 

Either iMirus or You may terminate this Agreement at any time. Without limiting the foregoing, iMirus may, in its sole discretion and without liability, terminate Your password, or use of the Product and Service for any reason, including, without limitation, if iMirus believes that You have violated or acted inconsistently with the letter or spirit of these Terms. Any termination of Your access to the Service under any provision of these Terms may be effected without prior notice, and IMirus may immediately deactivate or delete Your account and all related information and/or bar any further access to the Service. Sections 4, 5, 6 and 8-13 shall survive termination of this Agreement.

 

13 Miscellaneous

 

These Terms, the iMirus Reader License Agreement and the other rules, guidelines, licenses and disclaimers posted on the iMirus web site or other web sites constitute the entire agreement between iMirus and You with respect to Your use of the iMirus Product and Service and supersede all previous written or oral agreements between iMirus and You with respect to the subject matter hereof. These Terms shall be governed by the statutes and laws of the State of Oklahoma, without regard to the conflicts of laws principles thereof. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

 

14 Notification of Changes

 

From time to time, iMirus may revise these Terms to keep them up to date with iMirus's Products and Services. Please refer to www.imirus.com terms of service link periodically for any changes. The update date is used to alert You to recent modifications. Your access or use of the iMirus Product and Service subsequent to such an update will signify Your assent to be bound by such changes.

User Information

iMirus collects information from Users, which may include Personal Information, and Transaction Information at different points on iMirus' web sites or within iMirus' Readers as follows:

We receive and store information You enter on our Web site or give us in any other way.

 

Registration data:

 

When You register for a Product and or Service, iMirus may ask that You provide basic contact information such as Your name, address, and email address. This basic contact information will NOT be sold or provided to any third party other than publishers of 3rd Party Content that You are downloading or purchasing, such as a magazine, catalog, book, or other publication.

 

Order data:

 

When You subscribe or purchase 3rd Party Content through the iMirus Products and Services, iMirus may collect Your subscription, purchase, address and billing information including Your credit card number and expiration date.

 

Voluntary information:

 

iMirus may collect additional information at other times, including but not limited to, when You provide feedback, change Your content or email preferences, respond to a survey, or communicate with iMirus Customer Support.

 

Transaction data:

 

When You access a publisher's 3rd Party Content for an iMirus web site or within the iMirus Reader(s) the following transaction information is recorded and provided to the publisher for management reporting purposes: number and types of pages, web site link click throughs, for 3rd party magazines, number of advertising impressions and click-throughs, and number of times You access or download the publisher's 3rd Party Content from an iMirus web site. For 3rd party catalogs, number product impressions and click-throughs, and number of times You access or download the publisher's 3rd Party Content from an iMirus web site.

 

Information Collected Automatically

 

IMirus receives and stores certain types of information whenever You interact with iMirus web sites or the iMirus Readers.

 

Computer configuration:

 

iMirus automatically receives and logs information from Your browser, including Your IP address, Your computer's name, Your operating system, browser type and version, CPU speed, and connection speed.

 

Referral, click stream, and site interaction data:

 

iMirus may also record the URL You linked from to get to iMirus.com, Your click stream through and from our Web site, and other generally accepted tracking information.

 

e-Mail delivery, downloads, and open rates:

 

To help iMirus make our emails more useful and interesting, and to ensure that we are delivering the 3rd Party Content You have ordered, iMirus often receives a confirmation when You receive, download, and/or open email or digital Products or Services from iMirus.

 

Software installation and Products and Services access:

 

When You install the iMirus Reader and access or download 3rd Party Content or other files from an iMirus web site, for downloads iMirus may record when each file transfer begins and ends, any errors that interrupt the transfer, and the number of times You access a publisher's 3rd Party Content. For 3rd Party Content that is viewed within the iMirus online Reader, iMirus records the number of times You access the 3rd Party Content, if the publisher requires You to enter a User name and password to access the full content.

 

Information from Other Sources

 

iMirus may receive information about You from other sources, add it to our account information, and treat it in accordance with this policy.

 

Customer and order data from publishers, partners, affliates, or any 3rd Party Content provider:

 

If You place an order for a magazine, catalog, book, other publication, or media directly with a publisher or another iMirus partner or affliate for which iMirus provides fulfillment or other services, Your account information and order information is passed to us. IMirus will treat this information in the same accord as if Your account information and order information was taken directly through an iMirus web site, Product or Service.

 

Updated delivery and address information:

 

iMirus may obtain updated contact information from third parties in order to correct our records and fulfill Your orders or deliver communications to You.

 

Demographic and purchase information:

 

We may reference other sources of demographic and purchase information in order to provide You with more targeted communications and promotions.

 

How iMirus Uses Cookies

 

Cookies are alphanumeric identifiers that a Web site can store on Your computer's hard drive. When You visit the iMirus store, or an iMirus web site, create a User account, subscribe, purchase, download or access a Product or Service from us, or sign-in to the iMirus Readers we may set cookies on Your personal computer. iMirus may provide publishers, partners, and affiliates for whom iMirus sells or distributes 3rd Party Content or other products or services on behalf of said publisher, partner, or affiliate, with any Personal Information in connection with or as is necessary to fulfill Your requests for their products, programs or services, or to satisfy other core business functions. In such instances Your Personal information is transferred, Your Personal Information is governed by their respective privacy policies.

iMirus may employ other companies and individuals to perform functions on our behalf such as fulfilling orders, sending email, processing credit card payments, and providing customer service. iMirus sends email communications to Users in connection with our providing the iMirus Products and Services on behalf of publishers, partners, and affiliates. The following outlines the types of emails iMirus sends to Users, and the choices You have about which messages to receive.

 

e-mail Delivery Notification of Products and Services You purchased or subscribed to:

 

On behalf of the publisher, partner, or affiliate, iMirus may provide e-mail delivery notification that their Product or Services is ready for You to view and or download to the iMirus Readers. IMirus may also send You communications related to Your order, for example encouraging You to pay for or renew Your subscription or product.

 

e-mail Delivery Notification of Prospective Products and Services sent by iMIrus on behalf of the publisher, partner, or affiliate:

 

On behalf of the publisher, partner, or affiliate, iMirus may provide e-mail delivery notification for their prospective Product or Services. These emails will provide You with an opt out or unsubscribe capability to not receive future e-mails associated with the publisher's magazine title, catalog title, or book title.

 

Messages required to service or confirm Your iMirus Account:

 

iMirus may send newly registered Users a welcoming email, as well as messages confirming each order You place directly at imirus.com; confirming Your account changes; inviting You to participate in customer surveys; and informing You of important product or service updates.

 

Marketing messages about Publications You receive:

 

IMirus may send You marketing messages related to the Publications You receive, for example, encouraging You to purchase additional single copies or to subscribe.

 

Optional marketing message from iMirus:

 

Registered Users may also occasionally receive information or special promotions from IMirus about additional Products and Services. You may update Your preference with regard to receiving such messages by opting out in the Your Account area of the iMirus Web site.

 

Optional marketing messages from Trusted 3rd Parties with Your consent:

 

With Your consent, iMirus may share Your Personal Information (not including Your credit card information) with trusted third parties so that You may receive information or opportunities from them about relevant products and services they offer. You may update Your preference by opting in the Your Account area of the iMirus Web site.

 

Changing or Removing Your Information

To review or update Your Personal Information, or to alter Your email preferences, or preferences regarding how iMirus shares Your Personal Information, visit the Your Account area of iMirus.com.

If at any time You would like to close Your account, send email to support@iMirus.com. Your Personal Information will be removed from our active User database and will be deleted assuming that You are current with all payment obligations, that iMirus does not believe it reasonably necessary to keep such information for any pending legal action, and that iMirus is under no other legal obligation to retain such information. Please be aware that any unfulfilled subscriptions may be canceled without refund and You will have to re-register in order to use the iMirus Service. It is Your responsibility to request a refund from iMirus or the 3rd party merchant.

Security Practices

iMirus uses reasonable and current security methods to protect Your personal data. Your information will be stored in a database located behind multiple firewalls and accessible only to authorized personnel. iMirus does not encrypt normal Web sessions, but any financial transmission You input to our servers such as credit card or other Personal Information uses Secure Sockets Layer (SSL) software, which encrypts the information before the data is passed over the Internet. Password and credit card information is then stored in our database in an encrypted, non-human readable form.

Minors

iMirus does not knowingly collect, either online or offline, Personal Information from persons under the age of eighteen without parental consent.

Notification of Changes

From time to time, iMirus may revise this Privacy Policy to keep it up to date with iMirus's Products and Services. The update date is used to alert You to recent changes. If changes to iMirus's privacy policy will directly affect how iMirus shares Your Personal Information, iMirus will notify You by posting a notice on it's store web site, or by sending You an email and giving You an opportunity to opt out of such change. Unless we notify You otherwise, our collection and use of Your Personal Information is governed by the privacy policy in effect at the time such Personal Information is collected.

Refund Policy

Your satisfaction is very important to us. You may cancel digital subscriptions ordered at iMirus.com at any time. Single copy digital purchases will only be refunded in the case that You are unable to download the issue. iMirus will provide a refund for all unserved digital issues to the credit card used for purchase. For subscriptions or purchases of print-based products, iMirus will not provide refunds. The publisher or fulfillment company providing or distributing the print-based product will have to be contacted for a refund. In the event, a refund has been issued to You by the publisher or fulfillment company, iMirus reserves the right to contact You to verify the refund between You and the publisher or fulfillment company.

iOS Purchase and Cancellation Terms

In My Library, you can purchase subscriptions and single issues through your iTunes account. Some publishers may elect to promote free subscriptions and other paid subscriptions. Some paid subscriptions will be auto-renewable. For auto-renewable subscriptions, the term will be one year, and the number of issues during the term period will vary from title to title. The number of issues purchased for the annual period will be displayed on the app before you make your purchase.

The following applies to auto-renewable subscriptions:

  • Payment will be charged to your itunes Account at confirmation of purchase
  • Subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period
  • Account will be charged for renewal within 24-hours prior to the end of the current period, otherwise you will be charged for an additional one-year term
  • Subscriptions may be managed by the user and auto renewal may be turned off by going to user's Account Settings after purchase
  • No cancellation of the current subscription is allowed during active subscription period
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication.
  • Single-issue purchases are non-refundable

The following applies to normal subscriptions:

  • Payment will be charged to your iTunes Account at confirmation of purchase
  • Subscription will not automatically renew. You will be required to make an additional subscription purchase to continue to receive access to your iPad issues. You may do so by clicking the Subscribe button within the My Library / Available issues section of the app at any time after the expiration of your subscription term
  • No cancellation of the current subscription is allowed during active subscription period
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication
  • Single-issue purchases are non-refundable

Android Purchase and Cancellation Terms

In My Library, you can purchase subscriptions and single issues through your iTunes account. Some publishers may elect to promote free subscriptions and other paid subscriptions.   • Payment will be charged to your Google Play or Amazon Android Market accounts at confirmation of purchase
  • Subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period
  • Account will be charged for renewal within 24-hours prior to the end of the current period, otherwise you will be charged for an additional one-year term
  • Subscriptions may be managed by the user and auto renewal may be turned off by going to user's Account Settings after purchase
  • No cancellation of the current subscription is allowed during active subscription period
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication.
  • Single-issue purchases are non-refundable

The following applies to normal subscriptions:

  • Payment will be charged to your Google Play or Amazon Android Market accounts at confirmation of purchase
  • Subscription will not automatically renew. You will be required to make an additional subscription purchase to continue to receive access to your Android issues. You may do so by clicking the Subscribe button within the My Library / Available issues section of the app at any time after the expiration of your subscription term
  • No cancellation of the current subscription is allowed during active subscription period
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication
